Justice Neil Brathwaite dismissed a female juror on Monday after she broke down in tears during the testimony of a pathologist as he described the gunshot injuries that ended the life of a baby.

Defence lawyer, David Cash, raised concerns as to whether the juror, who was sitting on the murder and attempted murder trial of Antorn Anthony Davis, could be impartial, Loop News reports.

Prosecutors say Davis is responsible for the August 28th, 2017, shooting that killed eight-month-old Shelton Tinker Jr. and injured his parents Shelton Tinker Sr. and Jeffrina Sweeting.

Tinker had earlier testified that he was confronted by a gunman as he was about to enter his home during the early hours of August 28th, after attending a party.

He said he recognized the assailant as the defendant, whom he referred to as “Bigger,” and that he knew him since he frequently visited the area.

Tinker told the court that he had no dispute with Bigger.

He also said that the shooting had caused a rift in his relationship with Sweeting because she blamed him for the incident.
